2. Data protection officer

Our data protection officer is Anne-Sophie Buxbaum, who can be reached at datenschutz@nynex.de or by post at the address above, marked “Datenschutz” (data protection). Please contact our data protection officer at any time with any questions about data protection and to exercise your rights.

3. Principles

This privacy policy applies to the website nynex.de. Customers receive separate data protection information for the use of our telecommunications and other services.

We process personal data only to the extent necessary to operate this website or to handle your enquiry. This website uses no cookies, no analytics or tracking tools and no advertising or social media integrations.

4. Hosting and server log files

This website is operated on NYNEX satellite OHG’s own infrastructure in Germany. We do not use external service providers (processors) for this and do not transfer data to countries outside the EU/EEA. Incoming emails are processed on our own mail servers in Germany.

When you access this website, the web server automatically processes information transmitted by your browser: IP address, date and time of access, page or file requested, referrer URL, amount of data transferred, browser type and version, and operating system. Processing is based on Art. 6(1)(f) of the General Data Protection Regulation (GDPR; German: DSGVO); our legitimate interest lies in the technical provision, stability and security of the website. Log files are automatically deleted or anonymised after seven days at the latest. They are retained beyond this period only where necessary to investigate or defend against a specific security incident, in which case the log files concerned are kept until the incident has been resolved.

5. Contacting us

If you contact us by email or phone, we process the information you provide (e.g. name, company, email address, phone number, content of your enquiry) in order to handle your enquiry. The legal basis is Art. 6(1)(b) GDPR where your enquiry relates to a contract or to pre-contractual measures, and otherwise Art. 6(1)(f) GDPR (legitimate interest in responding to enquiries). We delete your data as soon as it is no longer required for handling your enquiry, provided no statutory retention obligations apply.

To handle your enquiry we need your name, your email address and your message; all other details are optional. Without these details we cannot answer your enquiry. Where correspondence constitutes commercial or business letters, we retain it for six years pursuant to § 257 HGB (Handelsgesetzbuch, German Commercial Code) and § 147 AO (Abgabenordnung, German Fiscal Code); accounting records are retained for eight years. No automated decision-making, including profiling, takes place.

The enquiry form on the contact page does not transmit any data to our server. It merely prepares an email in your email program, which you send yourself.

6. Storage in your browser

This website stores only one technical item in your browser: sessionStorage records whether the intro animation has already been shown in this session (entry “nynex-orbit-seen”); this entry is deleted when you close the browser window. It contains no personal data and is not transmitted to us. Storage is permitted without consent because it is strictly necessary to display the page you requested as intended (§ 25(2) no. 2 TDDDG, Telekommunikation-Digitale-Dienste-Datenschutz-Gesetz, German Telecommunications and Digital Services Data Protection Act).

7. Fonts

This website uses only fonts installed on your device. No fonts are loaded from third-party providers.

8. External links

This website contains links to external services (fiberone.de, nynex.ai, eauto-cash.de, peeringdb.com, bundesnetzagentur.de and openstreetmap.org). Data is transmitted to the respective provider only when you click such a link. The respective provider’s privacy policy applies to its data processing.

9. Your rights

You have the right of access (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR) and data portability (Art. 20 GDPR). To exercise these rights, please use the contact details above. Your right to object (Art. 21 GDPR) is described separately in section 10.

10. Right to object (Art. 21 GDPR)

Where we process your personal data on the basis of Art. 6(1)(f) GDPR (server log files, responding to general enquiries), you have the right to object to this processing at any time on grounds relating to your particular situation. We will then no longer process the data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims. Please send your objection to the contact details given in section 1 or 2.

11. Right to lodge a complaint

You have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR), in particular in the Member State of your habitual residence, place of work or place of the alleged infringement. The authority responsible for us is the Hessische Beauftragte für Datenschutz und Informationsfreiheit (Hessian Commissioner for Data Protection and Freedom of Information), Wilhelmstraße 7, 65185 Wiesbaden, Germany, phone: +49 611 1408-0, email: poststelle@datenschutz.hessen.de, www.datenschutz.hessen.de.

Insofar as the processing concerns the provision of our telecommunications services or the storage of information on your device (section 6, § 25 TDDDG), the competent authority under § 29 TDDDG is the Federal Commissioner for Data Protection and Freedom of Information (Bundesbeauftragte für den Datenschutz und die Informationsfreiheit, BfDI), Graurheindorfer Straße 153, 53117 Bonn, Germany, email: poststelle@bfdi.bund.de, www.bfdi.bund.de.

12. Data security and changes

Data is transmitted between your browser and our server using TLS encryption. We protect our systems with technical and organisational measures against loss, unauthorised access and manipulation. Please note that data transmission over the internet, for example by unencrypted email, may not be completely secure.

We will amend this privacy policy whenever the website or the legal requirements change. The version published here applies.
